How do I get these crimes off my record?

The criminal justice system can be very unforgiving and often times very unfair. The majority of people that are charged with crimes end up with at least one conviction on their record. This is unfortunate, because we live in a time when a past mistake or transgression can follow you for the rest of your life. One need only “google” a person’s name or look on medfordmugshots.com to see an arrest or a conviction.

Fortunately, many types of arrests and convictions are expungable. Expungement is a process where a Judge seals a case so that it is no longer public information. The Judge also sends out an order – to the FBI, the Oregon State Police, and the District Attorney’s office – and orders that they remove the case from their system.

The purpose of an expungement is to clean up your record. If you are successful then it will mean that for all purposes you are deemed to have never been charged with the crime. The crime will be “off your record,” and you can answer “no” to the question of whether you have ever been convicted of a crime.

Scales of JusticeGeneral Principals to Expungement

  • A single conviction can be expunged in three years
  • More than one conviction triggers a ten year wait for all convictions on your record
  • You cannot have been charged with a crime within the last three years
  • B felonies require a 20 year wait
