Will I Have to Serve Jail Time?

For first-time DUI offenders, jail time is unlikely. Most people qualify for a diversion program, which involves completing alcohol education classes in exchange for having the charge dismissed. The program can be demanding, but for the majority of people, it’s the best option. More than 95% of eligible individuals choose to participate.

Should I Begin Alcohol Treatment Now?

It’s best to wait before enrolling in alcohol treatment solely because of your DUI. Any classes taken before your case is resolved may not count toward the required program. However, if you feel you need help addressing alcohol use, it may be worth discussing options with your attorney.

Will My Driver’s License Be Suspended?

License suspension varies based on the circumstances of your case. If this is your first offense, there’s a chance—about 30%—that you won’t face a suspension. However, for most first-time offenders (about 70%), some form of suspension is likely.

  • If you failed a breath test by blowing over 0.08%, your license may be suspended for 90 days.
  • If you refused the breath test, you could face a one-year suspension.

You may be able to challenge the suspension, but you must act quickly.

What Should I Do Next?

You need to request an Implied Consent Hearing within 10 days of your arrest. Instructions for making this request are included in the paperwork given to you at the time of your arrest. If you plan to hire an attorney, consult them before making the request.
