Pre-Charge Investigations Attorney

I frequently represent clients that are under investigation by law enforcement. If you are under investigation then you need to consult with a defense attorney immediately. Your case is likely at a very critical stage. Every decision you make at this stage will have a tremendous effect on the case against you.

If you believe that law enforcement is investigating you for any crime then you need to know that they are likely working to build a case against you in secret. At the point in the investigation that they contact you the police have likely already built a case against you and they have certainly already made up their mind that you are guilty.

BEGIN DEFENDING YOURSELF

The work that you can do to protect yourself needs to begin now. When your case is transferred from the police to the prosecutor the prosecutor will consider whether any defense exists or not in your case. I will sit down with you in my office and explain to you what you need to know. If you hire me then we will likely employ an investigator to begin taking statement and collecting evidence that we can later use in our defense.

TIPS

• Do not speak with law enforcement before talking with a lawyer. You have the right to remain silent and you should exercise that right. The police have likely already decided that you are guilty. You will not talk them out of charging you. The police frequently take people’s statements out of context in order to make them look guilty. If you are going to make a statement then you want to do it on your terms, after you have spoken to a lawyer.
• Have your affairs in order. If you are being investigated then you will likely soon be arrested. Make sure that your home, family, and pets are taken care of. Have a family member ready to try to bail you out of jail.
• Beware of the pretext phone call. The police (or anyone for that matter) can record a phone call that they are engaged in with you. The police frequently call or have someone else call a suspect and try to get them to talk about the incident. This is a phone call that they are recording and that they intend to use against you. Do not speak about your case over the phone.
• Do not speak about your case to anyone. The first and only person you should speak to about your case is your lawyer. No one else.
• Do not take a polygraph. If you have already been working with the police then stop. They may want you to take a polygraph. Do not take this polygraph.
