OREGON DUII PENALTIES
The penalty that you will face for a DUII conviction in Oregon depends on many different facts, including: your criminal history, the facts of your particular case, whether you went to trial or not, how well your lawyer does for you, and what kind of mood the Judge is in. If you have been charged with a DUII you may be eligible for diversion, especially if this is the first time you have been charged.
First Conviction
- Jail – minimum of 2 days if convicted, likely sentence of 30-60 days
- License suspension – 1 year
- Fine – minimum of $1,000 and maximum of $10,000
- Various DUII fees – usually $300
- Installation of Interlock Ignition Device – 1 year after suspension
- Complete substance abuse evaluation and treatment – minimum of 90 days
- Participate in the Victim Impact Panel Presentation
Second Conviction
- Jail – minimum of 2 days if convicted, likely sentence of 60-120 days
- License suspension – 3 years (if within 5 years of prior conviction)
- Fine – minimum of $1,500 and maximum of $10,000
- Various DUII fees – usually $300
- Installation of Interlock Ignition Device – 2 years after suspension
- Complete substance abuse evaluation and treatment – minimum of 90 days
- Participate in the Victim Impact Panel Presentation
Third Conviction
- Class C felony if other convictions were within the last 10 years
- Jail – maximum sentence of 5 years in prison
- License Suspension – permanent revocation
- Fine – $2000 minimum and maximum of $10,000
- Various DUII fees – usually $300
- Installation of Interlock Ignition Device – 3 years after suspension
- Complete substance abuse evaluation and treatment – minimum of 90 days
- Participate in the Victim Impact Panel Presentation
